Right of First Refusal Policy

1. Purpose

This Policy sets forth the conditions and procedure for exercising the right of first refusal With regard to purchases made electronically through MEPEGO EU, in accordance with Article 47 of Law 1480 of 2011 (Consumer Protection Act) and other applicable Colombian regulations.

2. What is the right of first refusal?

The right of withdrawal is the consumer’s right to unilaterally terminate a contract entered into through e-commerce channels, without having to justify their decision, provided that the withdrawal is made within the time limit and meets the conditions established by Colombian law.

3. Deadline for Exercising the Right of First Refusal

In accordance with Article 47 of Law 1480 of 2011, the consumer may exercise the right of withdrawal within five (5) business days following delivery of the product, provided that the transaction in question is one to which this right legally applies.

The application must be submitted within the time limit established by current law.

4. Conditions for Exercising the Right of First Refusal

To exercise the right of withdrawal, the product must be returned in accordance with the conditions established by applicable law. Specifically, it must:

  • It has not been used.
  • Be in good condition.
  • Keep the original labels, if applicable.
  • Keep the original packaging, when applicable.
  • Include any accessories and manuals, if applicable.
  • Must not show any modifications, alterations, or damage attributable to the consumer.

The consumer must allow the product to be inspected when necessary to verify compliance with the conditions applicable to the exercise of the right of withdrawal.

5. Products Excluded from the Right of Withdrawal

In accordance with the exceptions set forth in Colombian law, the right of first refusal shall not apply, among other cases, to:

  • Products manufactured according to the customer's specifications.
  • Custom products.
  • Products manufactured according to special specifications requested by the customer.
  • Goods that, by their nature, cannot be returned or are likely to deteriorate or expire rapidly, where applicable.
  • Products whose deterioration or damage is attributable to the consumer.

Applicable exclusions will be determined based on the nature of the product and the applicable legal provisions.

6. Procedure for Exercising the Right of First Refusal

Consumers who wish to exercise their right of withdrawal must notify MEPEGO EU of their decision within the established legal timeframe via email at:

The application must include, to the extent possible, the following information:

  • Full name.
  • Identification document.
  • Order number.
  • Date of purchase.
  • Product purchased.
  • Express declaration of the intention to exercise the right of retraction.
  • Additional information to identify the purchase and process the return.

MEPEGO EU may request additional information when necessary to verify the purchase and properly process the request.

7. Product Return

Upon receipt of the withdrawal request, MEPEGO EU will inform the consumer of the instructions and the address to which the product must be sent.

The consumer must return the product under the conditions established by applicable legislation and within the corresponding timeframe.

Transportation costs associated with the return of the product shall be borne by the consumer, in accordance with applicable legal provisions.

8. Refund

Once the product has been received and compliance with the legal conditions for exercising the right of withdrawal has been verified, MEPEGO EU will issue a refund within the timeframe established by Colombian legislation.

The refund will be made using the same payment method employed by the consumer, where possible, or through the appropriate mechanism or one agreed upon by the parties.

MEPEGO EU may request the information strictly necessary to process the refund when the payment method used so requires.

9. Product verification

MEPEGO EU may inspect the received product to verify compliance with the conditions applicable to the exercise of the right of withdrawal.

During this review, it will be possible to verify, among other aspects, that:

  • The product has not been used.
  • It is complete.
  • Maintain its original conditions and characteristics.
  • Include the corresponding accessories, labels, and items, where applicable.
  • It must not show damage, modifications, or deterioration attributable to the consumer.

The review will be conducted taking into account the nature of the product and the provisions established in Colombian legislation.

11. Validity

This Right of Withdrawal Policy comes into effect on August 1, 2026 and shall remain in effect unless modified or updated by MEPEGO EU.

Any modification will be published on the MEPEGO EU website and will apply in accordance with applicable legal provisions.
